Mandatory mediation in new foreclosures starts March 13
Friday, February 20th, 2009 by TCPalm.comThousands of distressed Treasure Coast homeowners could have a better chance to stave off foreclosure as a result of a judicial order set to go into effect on March 13.
The order would require all lenders filing home mortgage foreclosure lawsuits involving owner-occupied houses to participate in a mediation program to see if they can work out a deal with the borrower, said 19th Circuit Chief Judge William Roby.
The goal of the program is to keep families in their homes, save money for banks and taxpayers and ultimately stabilize the real estate market and the economy, said Roby and others helping to formulate the program. It would be the first program of its kind in Florida.
There is no end in sight to the mortgage foreclosure crisis on the Treasure Coast, Roby said.
Stuart judge off case involving Martin Memorial
Friday, January 23rd, 2009 by TCPalm.comSTUART — Chief Circuit Judge William Roby has removed himself from an upcoming trial pitting the guardian of a brain-damaged Guatemalan native against Martin Memorial Medical Center over his 2003 deportation after having lived at the hospital’s acute care unit for two years.
Roby ordered his disqualification to preside over the civil kidnapping and false imprisonment case after Luis Alberto Jimenez’ cousin, Montejo Gaspar Montejo of Indiantown, filed court papers Thursday noting that Roby once worked for the Stuart law firm that had assisted Martin Memorial gain a court order allowing the hospital to fly Jimenez back to Guatemala.
