Surfrider’s 25-year celebration in Port St. Lucie owes $75,000 in debts

STUART — The nonprofit Surfrider organization isn’t doing much celebrating two weeks after its 25th anniversary Arts and Music Celebration has left about $75,000 in unpaid debts, about half to local vendors.

The Treasure Coast chapter president has resigned under pressure from the local board, which said he exceeded his authority in organizing the event.

And, the Surfrider Foundation’s Florida group of chapters has canceled its state conference to put that money toward paying the bills.

Port St. Lucie may hike storm water fees to improve drainage

Residents may see their annual storm water fees increase by about $16, according to city officials.

The council gave preliminary approval at its Monday night meeting to move forward with a project that improves the drainage system and purchases land to resolve flooding issues the east side of the city dealt with during Tropical Storm Fay.

The project would benefit the residents east of U.S. 1 and south of Jennings Road. Cooper said the residents in the western part of the city may have complaints.

Riled Port St. Lucie homeowner prefers invasive trees over invasive traffic noise

PORT ST. LUCIE — When Maria Trigueiro and her husband, Jose, bought a home in Lake Forest after living in New Hampshire, they did so under the impression that the vegetative buffer between the home and Florida’s Turnpike would remain untouched.

About six years later, Trigueiro is upset that St. Lucie West Services District officials are pulling up invasive, non-native Brazilian pepper trees in the surrounding community. The trees behind her house are still in the ground, but she is worried they will be coming down soon.

Under its development permit through the South Florida Water Management District, St. Lucie West Services District is required to check its property and destroy invasive plants such as the Brazilian pepper, which crowds out native vegetation and can damage the local environment.

Jetty Park in Fort Pierce to double in size

FORT PIERCE — Soon residents and visitors to South Beach’s Jetty Park will get to enjoy more waterfront views, parking and easier access to a 2 1/2-mile linear park.

The City Commission, seated as the Fort Pierce Redevelopment Agency board, Wednesday approved a $1.4 million land acquisition that will double the size of Jetty Park to 2.87 acres.

The purchase is for 1 acre on the eastern side of the vacant Mariner Bay Motel property, formerly the Days Inn, at the corner of Seaway Drive and State Road A1A. (more…)

Signs of economic hard times plentiful in Martin County

STUART — Signs of economic distress abound in Martin County and the outlook for next year doesn’t appear to be much better.

Martin County’s population dipped slightly since last year, school enrollment is expected to decline for two years, government revenues are down and new construction has dropped, several local and state officials said this week during government meetings.

The housing market is so bad two developers asked Martin County to rescind their hard won final site plan approvals for new subdivisions so they can delay paying impact fees and utility connection charges, said Growth Management Director Nicki van Vonno.

“That is a recent trend and it’s directly tied to the applicant’s ability to go forward or not,” van Vonno said. “Money is tight.”

The County Commission voted unanimously on Tuesday to rescind the final site plan approval for the Pentalago subdivision, 42 ranchettes on Citrus Boulevard near Interstate 95 in Palm City Farms. (more…)

Martin County Commissioners kill proposal for Quillen development

INDIANTOWN — The long-stalled Quillen Development of Regional Impact is dead and the developer is missing in action.

The Martin County Commission voted unanimously Tuesday to kill the proposal for 2,250 houses and 150,000 square feet of commercial space at the intersection of Warfield Boulevard and Allapattah Road in Indiantown.

Officials with the project’s developer, Ascot Development of Delray Beach, did not attend Tuesday’s public hearing on the fate of the project, which was first proposed in December 2005. The developer paid $58.5 million for the land.

Judge rules condo buyers must pay developer’s attorney’s fees

Hundreds of boom-time buyers in Florida have tried to use the Interstate Land Sales Act to wiggle out of real estate contracts. Some have been successful, others haven’t — but a recent ruling shines light on the risk involved in pursuing such cases.

A magistrate judge ruled late last month that three buyers at St. Lucie County’s Ocean Bay Villas who were suing in an attempt to get their deposits back must repay $76,600 in attorneys fees and costs to the developer, Stuart-based Pukka Development Inc.

“The question is: Do these lawyers explain to these buyers the risk if they lose? The developers are going to go after the attorney’s fees,” said Mark Grant, a partner at Ruden McClosky in Fort Lauderdale who represented Pukka.

In the Pukka case, the plaintiffs — Saverio Pugliese, Michael Mieves, Antonio Saladino and Stephen Matalyak — claimed Pukka violated the Interstate Land Sales Act because it didn’t file specific property reports required by the U.S. Department of Housing and Urban Development.

The U.S. District Court Southern District of Florida ultimately ruled that Pukka was exempt form the reports.

Jury awards Chuck’s Seafood owner almost $64,000 in fight over restaurant

— A jury says Lewis Barton owes Peter Angelos $63,797 for legal fees and other expenses from the two men’s court battle over Chuck’s Seafood.

The three-man, three-woman jury deliberated about 40 minutes after a one-day trial at the St. Lucie County Courthouse, reaching their decision late Wednesday evening.

Angelos bought the eatery on Seaway Drive on Hutchinson Island in 1986 and sold it to Barton in May 2004 for $1.45 million. However, when Barton failed to keep up payments, Angelos went to court to get the restaurant back, and after a seven-month legal battle, he did.

Acting as his own attorney, Barton admitted he owed Angelos some money, but not the nearly $75,000 Angelos was seeking.

Study shows Martin faces headwinds to business recruitment

More than three-quarters of Martin County businesses say they don’t have room to expand.

If they can’t grow where they are - and if they think it’s too cumbersome to get permits - they’re likely to leave. That’s a conclusion of a new report commissioned by the Business Development Board of Martin County.

The assessment of Martin County’s competitiveness - or, more accurately, lack thereof - highlights challenges to business recruitment and expansion, including the high costs of building permits and a lack of move-in-ready space. (more…)

St. Lucie County superintendent blames legislators for job and school cuts

FORT PIERCE — A plan that includes eliminating 331 jobs and closing three schools to cut $30.6 million from next year’s budget was explained in detail Tuesday evening to elected members of the School Board, who sat silent through the presentation by Schools Superintendent Michael Lannon.

Their lack of comment was deliberate. Chairwoman Judi Miller said after the meeting all five members of the School Board had previously agreed in individual conversations with Lannon not to speak until after a town hall meeting on the proposal, scheduled for 6 p.m. March 31 at Fort Pierce Central High School auditorium.

Lannon spoke for almost one hour on a problem that he laid entirely at the feet of Tallahassee lawmakers who refuse to raise more money in the face of shortfalls created by the economic recession.
