Note to teens facing a potential prison term: don’t use your MySpace page to post photos of police officers and wish “AIDS and genocide to all law enforcement.”

That’s what Stuart resident Jesse Alan Walker, 19, did while awaiting a June trial in which a jury convicted him of robbery with a firearm related to a 2008 home invasion armed robbery. At trial, he was accused of planning the robbery with two then-20-year-old co-defendants, who once played football for Jensen Beach High School.

“I hate the (expletive) police,” Walker posted on MySpace last December, along with photos of Stuart Police officers and derogatory comments.

STUART — Nine years ago, a drunk Donald Flewellen drove a stolen van across the center line, causing a collision that killed two people and left illegal Guatemalan immigrant Luis Jimenez permanently brain damaged.

Less than four months after his December release from prison for two counts of DUI manslaughter, authorities say Flewellen, 52, was behind the wheel of a borrowed car and caused a hit-and-run crash with property damage in Fort Pierce.

Already charged with two counts of violating his supervised release, court papers show when Flewellen returns to court Aug. 17, he’ll face additional charges of leaving the scene of a crash with property damage and driving on a revoked driver’s license related to an April 5 traffic collision.

OKEECHOBEE COUNTY — The death of a 49-year-old woman found by family members appears to be a homicide, and a sheriff’s spokesman Wednesday said a neighbor has been taken into custody.

Okeechobee County Sheriff’s Office deputies went Tuesday night to an address in the 2700 block of Northeast 11th Court and met with Roberta “Bobbie” Elizabeth Christensen’s son and daughter-in-law.

They reported coming to the residence in the Pine Ridge Park subdivision to see Christensen, a waitress at Golden Corral, and finding her dead inside.

A preliminary examination indicated the death was “most likely the result of a homicide,” a release states.

“The nature of the injury appears to be from a sharp instrument,” the release states.

A neighbor in his 20s was taken into custody Wednesday and Detective Ted Van Deman, sheriff’s public information officer, said he will be charged in connection with the death.

“We’re confident we have the right person in custody,” Van Deman said.

Sheriff’s detectives are interviewing others to determine whether anyone else could have played a role in the death.

The Sheriff’s Office declined to reveal a possible motive and also declined to provide further details about Christensen’s injuries.

ST. LUCIE COUNTY — Law enforcement agencies are working to get rid of the hundreds of backlogged DNA cases to make for a safer Treasure Coast.

The Indian River Crime Laboratory hired a DNA criminalist through a $94,922 forensic science improvement grant with the Port St. Lucie Police Department from the U.S. Department of Justice’s National Institute of Justice.

Lab Director Dan Nippes said the backlog for St. Lucie, Indian River, Martin and Okeechobee counties at the end of June was 646 cases.

VERO BEACH — The first Treasure Coast drug dealer convicted of murder in a drug overdose death case got sentenced to 30 years in state prison Thursday, the maximum penalty.

Drug dealer William McCartney III, 23, will serve up to 30 years in state prison, Circuit Judge Robert Hawley ruled Thursday. McCartney was sentenced as a habitual offender, making it harder for him to earn parole.

Hawley ordered him to 30 years in jail for third-degree murder, 30 years for selling two capsules of methadone and 10 years for selling a number of pills of Xanax, an anti-anxiety medication.

But all the sentences will run at the same time, totaling 30 years. (more…)

Asked in a questionnaire by Scripps Treasure Coast Newspapers for TCPalm.com’s “Ask the Candidates” page whether they had been convicted of a felony, both candidates on the ballot for state Senate District 28 seat wrote “no.”

The answer from one of the candidates isn’t accurate, according to a Scripps Treasure Coast Newspapers investigation.

According to court records and the U.S. Attorney’s Office for Eastern Pennsylvania, Democrat Bill Ramos, a mortgage broker from Jensen Beach, pleaded guilty to a single count of embezzlement of postal funds — accepting a three-year probation and repaying the missing money — in 1989. That charge is a felony.

Ramos said Thursday he didn’t consider pleading “no contest” the same as a conviction.

“I answered specifically as it was asked,” Ramos said. “It just said have you ever been convicted of, and I answered no. I plead no contest.”

The court documents show Ramos pleaded guilty.

Assistant State Attorney John Cannizzaro, of Florida’s 19th Judicial Circuit in Fort Pierce, said judges advise defendants before they enter a guilty plea that the action is the same as being convicted at a jury trial.

VERO BEACH — Indian River County Administrator Joe Baird’s first public appearance in his DUI case came Wednesday in a court hearing that was quickly postponed at the request of defense and prosecution attorneys.

The attorneys said they needed more time to prepare their cases.

But Indian River County Judge David Morgan told the attorneys he intends to set the case for trial the week of Aug. 24.

Baird has pled not guilty to DUI and speeding charges and is asking for a jury trial.

Outside the courtroom, Baird, 52, declined comment on the advice of his attorney. He was accompanied by his girlfriend, Karen Deigl, president of the Indian River Senior Resource Association, who was there for moral support and to drive him to the hearing, Baird said.

The state revoked Baird’s driving license because he refused to take a Breathalyzer test at the time of his arrest on the night of May 16.

Baird’s case next comes up for court review on Aug. 19 when Morgan is scheduled to take up what he didn’t hear Wednesday: Defense attorney Bobby Guttridge’s request that charges against Baird be dismissed because he said police didn’t have justifiable reasons for stopping him.

Police said he was speeding and made a wide turn, according to court records.

Also, Guttridge wants Morgan to suppress Baird’s statement to police that he was going to the Long Branch Saloon, a bar in Vero Beach, when he was stopped by police.

Assistant State Attorney David Dodd said he may have some additional witnesses. Before trial, attorneys are allowed to interview witnesses who may be called to testify at trial.

VERO BEACH — Court hearings on County Administrator Joe Baird’s traffic cases have moved to after 1:30 p.m. today at the Indian River County Courthouse on State Road 60, according to the office of the judge handling the case.

Hearings were to be held this morning on motions filed by Baird’s attorney, Bobby Guttridge. But County Judge David Morgan has moved them to this afternoon when he will review the status of a number of cases, his office staff said.

Baird, 52, was arrested May 16 on charges of DUI and speeding. That was in connection with late-evening traffic stop in Vero Beach.

INDIAN RIVER COUNTY — The attorney for County Administrator Joe Baird says the police traffic stop that led to Baird’s arrest on DUI and speeding charges was illegal.

PALM CITY — Hard financial times have turned tumultuous at a local church, with the pastor using a sheriff’s deputy to keep elders outside the sanctuary doors and the elders, in turn, filing suit to remove the pastor.

In the lawsuit filed Wednesday in Martin County Circuit Court, seven members of Palm City Christian Church charge Pastor Anthony “Pastor Tony” Galbicka with breach of fiduciary duty and seek a ruling “ousting” him and voiding the “improper and/or illegal” actions he took.

The suit also alleges Galbicka slandered one plaintiff, Edward Taudien, when the pastor told other church members Taudien had stolen money from the church. The suit counters that Taudien had donated more than $168,000 to the church and loaned it $200,000 to build the sanctuary at 6450 Martin Highway in western Palm City.

Galbicka could not be reached Thursday at his home in Palm City, at the church, via telephone or by e-mail.

Robert J. Watson, a Stuart attorney representing the plaintiffs, said he expects a hearing on his request for a temporary restraining order against Galbicka to be scheduled late this month or early August.

According to the lawsuit, the 80-member church “began to struggle financially” this year; at a May 28 meeting attended by Galbicka, the elders approved several spending cuts, including reducing the pastor’s salary “by a modest percentage.”

Watson said the cut was to be about 15 percent, adding the church paid Galbicka’s housing and car expenses plus $22,000 a year. Details of how to make the cut had not been worked out, he said. (more…)
