Port St. Lucie 19-year-old accused of having ‘consensual’ sex with 14-year-old
November 22nd, 2009 by TCPalm.comA 19-year-old Port St. Lucie man was arrested after he picked up a 14-year-old girl from Port St. Lucie High School after noon Friday, had consensual sex with her at a house and then took her back to school, according to a St. Lucie County arrest affidavit.
Luis Adrian Gonzales Jr., of the 300 block of Northwest Rebecca Avenue, was charged with felony lewd and lascivious battery. He also was charged with a felony interference with custody and a misdemeanor contributing to the delinquency of a minor for removing a child from school without the authority to do so, according to the affidavit.
He was released from the county jail Saturday, said jail officials. His bail was $28,000 for all the charges.

And, what were the school and the girl charged with? Who was responsible for letting this girl leave school? Who was responsible for teaching this girl that if she gets into a car and leaves school with a 19 year-old boy that something like this was likely to happen? I doubt if she thought he was taking her out for ice cream.

Obviously this girl is not an angel. She knew they were not going to talk. Why is the guy the only one being punished? His whole life will be ruined. He didnt take her out by knife point. She willingly entered his car. There needs to be reform concerning situations like this one. You cannot rape the willing!

The headline is right. He is a man, she is a child. Even if she had done this before (and I don’t doubt that she has), he is an adult and knows damn well that having sex with a 14 year old is against the law.

14 year old-woman?? Seriously? While I don’t support prosecution on consensual sex between say a 17yr old and a 19yr old, 14 is still very much a child. This isn’t a story about two children (for example a 14yr old and 15 yr old), but an adult and a child. At 19, one is an adult. Society and hence our laws need to protect our children. At 19, this man needs to say “NO” to sex with children. While these young girls dress and act much older, they lack the judgment that an adult has. This girl may not be an angel, but at 19, this guy needs to be held accountable for HIS actions-which was premeditated sex with a kid.

Mica, the reason ‘the guy is the only one being punished’ is because he is the only adult who committed a crime. I love the way you place the blame on the child! And yes, a 14-year-old is a child, and this one obviously did not received what training and self-esteem she needed from the adults who raised her. So, his life is ruined because he broke the law!
As for the headline, I agree with Carolyn and disagree with Lynn, who also seems to think it’s fine for an adult to break the law by having sex with a child!

Seems some people have really forgotten that it doesn’t matter that she was willing. She is not mature enough to be left responsible for things she is too inexperienced to recognize. That’s why the law is there in the first place. Only if we had the power to imagine that that little girl was our daughter, I am sure these responses would be very different. But because we can’t see that far we persecute the victim and show empathy for the offender who is old enough to know that a 14 year old girl is not legal for him to date much less have any kind of sex with.
Also please direct me to the portion of the article that mentions that he was an illegal alien. Someone has mentioned it with great conviction but I don’t see that point mentioned here.

For the teens that actually read these comments and for the parents of male teens that are reading these comments. Please take a lesson from this and do your best to impart it to your friends and sons. Statistically speak the underage girl in these cases almost never gets charges pressed against her. We all know that this is wrong but it is the way of things. If you are a male (regardless of age) think twice about what a romp in bed may mean if you are dating an underage girl. You safest bet is to keep it in your pants until she reaches the age of consent. Mainly because regardless of whether or not it is consensual if her parents find out you may as well kiss life as you know it goodbye.

It is so funny as i sit here and read all these comments and read the story. But in life you have to look at things like this yes the 19 year old guy was wrong but still now a days these 13, 14 and 15 year old girls looking older and more mature than we 19 and 20 year old females. These young girls now a days are also capable of doing alot of things like also forcing there self unto older men, you never now she may have proberly lied about her age to this young man, these are the question you should ask did she or did she not lied about her age. Next to the school hmmmmm what can i say thats why we BRITISH studends are so different than these AMERICAN studends. From since I came here for college I have been soooooooo disappointed with the rules of the school. What or where in the BRITISH island you can see students leaving school without a written note or a parent present when they are leaving. Wow then they question why things like this happens. The way the rules are for school here they can’t expect the students to act much more different than how they act.

Sorry but nineteen is not a man, the law may say that this is the legal age but a nineteen year old boy is nothing close to being considered a man on any level.
He is a TEEN still and should be treated as such.
It is one thing for a grown man to lure in a fourteen year old and have sex with her. It is a horrible crime should be punished to the fullest extent of the law. It is something else for a teen to have sex with another teen. This little girl was a willing participant. Now the boys life is ruined forever with a criminal record.

This girl is my friend and she is a lier . She lied about her age to this young man . While on the bus she called him and asked him can he please pick her up from school. after she hung up the phone with him she told me that she wants to have sex with him but he don’t know. it’s a surprise,I then asked her does he know your real age and she told me no I lied to him telling him that I am 18 and she told his mom she was 17 when he had went to the restroom.The way I feel is, it takes two to tangle and it’s not like he raped her like there saying because she told me she was going to anyways.So to me he should not get in trouble for this because it’s not only his fault it’s her’s as well.

The parents should take action on what there child is doing and who they are doing these things with.Blaming someone for something you did wrong is not right.Carma is a biotch and it will come back but 10 times worst.I think this young girl was setting this kid up because if this young man is a good man and A B student and a graduate with a clean record , why would he waste his time on a little girl? This girl has on her myspace that she is 18. I was around during phone conversations and this girl stated she was 18 and what she had to say is nothing short of adult behavior with the sexually explicit pics she sent on the phone alone.
This is a good guy. He was around my kids daily and there was never a worry. He is responsible and respectful.
The only ones in the wrong here is this girl and her parents not paying attention or caring what she is doing. Or how about this school not watching the teenagers they are responsible for.
This guy was in a relationship with a girl! Why should he spend the rest of his life labeled something he’s not for stupidity of falling for someone who was raised with no respect for herself or anyone else much less any morals.

I am witness to conversations between these two people. I am 33 yrs old and I have a 14 yr old daughter that I had complete trust with him around because I know what is going on with my children and he is just another kid himself. This young man is not a sexual predator or felon. Naive maybe to fall for this girl full of lies and distaste. This girl is being charged with nothing and her parents are not being charged with neglect or abuse. I want his mother and him to know I WILL testify to the facts. He does not deserve any of this.
By the way… the issue of prejudice, just because this man has a hispanic name does not make him illegal. And he deserves more respect than most gringos!!!

I understand if he wasd aware thatt she was 14 then yes he should pay but if you with someone for a while and they’ve been telling you im 18 or whatever the age you going to trust in that person. This young man trusted and believed that she was 18. Girls now and days need to know that lieing doesnt make you a better person. If you really like someone and they are over age wait until you are much older or just find anthoer guy. Natalie if you really liked him and you know what you did is wrong why are you letting this poor kid suffer for your doing. Did your parents know about this? Unfortunately statutory law is strict liability and even if the girl lied, mistake of fact is no defense for sex with a minor.
Other sexual batteries are felonies of the second degree including carnal intercourse with an unmarried person under 18 and of previously chaste character, or intercourse with a person who is 15 or younger by a person 18 or older. Consent is not a defense, nor is lack of previously chaste character a defense if caused by previous intercourse with defendant.
Ignorance of age, even if due to the victim’s misrepresentation, is no defense.
Consent by the victim is a defense when the victim is 12 or older, except as to the crime of carnal intercourse with a minor of previously chaste character.
So it sounds like the best defense for the guy is to find that she already had sex with other guys before; then he can use the consent defense.

I absolutely think fourteen is still a child. A man five years older is A LOT at this age, and he should no better than to have sex with such a young girl. It should be against the law, and there should be penalities. Why are people so concerned about the family of this young man being ruined? Fourteen is too young to make good decisions, even if she “thinks” she wants to be with this man, she doesn’t have the abiltiy to make proper choices. look, im gonna tell you all something about this girl that i think you all need to hear because it’s very rediculous that you’re putting the blame on her and trying to make it seem like she’s the bad person because i know for a fact that none of you are her friends, you’re nothing but immature high school kids that just don’t like her so you’d be willing to say anything to make her look and feel bad. this is her older sister and i’m going to let you know the real story. yeah she lied about her age but she didn’t tell him that she was 17 or 18. when they met he was 18 and she told him that she was 15 when he asked because they met while they were at a friends house, the same friend that was with her the day they skipped school. natalie and the otehr girl they were with planned the day before that they didn’t want to go to school so they decided to skip, that’s when they called him and told him about it and he said okay. she didn’t call him when she was at school, all she did was wait for him. his mother never asked her how old she was, she asked the other girl and the other girl told her taht she was 15 so that should have automatically told her something. no, she doesn’t usually she do thiings like this. the minute that she got into high school is when she started doing bad and getting in a lot of trouble. she mostly started getting into a lot of fights and is now on probation, one of her older brothers used to be at the same school but was kicked out because he also gets into to much trouble. i’m thinking that the fact that he used to go to that school and he has a reputation probably made her feel that since that’s her brother she should follow him, but i think she went about it wrong. he also knew that she is only in the 9th grade and he should have known that obviously she isn’t going to be 17 or 18 and a freshman. while what she did was wrong at least she was mature enough to admit she did wrong and admit to everything when she could have very easily kept him safe and denied everything.

I’m guessing that most of you that are making these comments are minors and do not understand the law. Thumbs up to the comments of those who understand. I am 51 years old and soon to be 52 and I don’t look my age at all. I look to be 35 years old. But, that’s not the point. Recently my daughter went into a Tatto Salon and got her tongue pierced. She is only 17 years old and looks like a 21 year old, but she is a minor. As a result I had to take her to the emergency room because it got imbedded in her tongue. Yes, she lied about her age to get her tongue pierced without understanding the implications and dangers of her action. I said that to say this: The salon should have asked for a state ID, NOT A FAKE ONE. Any man that is 18 or older is an adult. Any child that is 17 or younger is a minor. THIS GUY SHOULD HAVE ASKED FOR A REPUTABLE ID, SUCH AS A STATE ID. Ignorance is not an excuse and you can’t just believe what these young girls are telling you. I feel sorry for the young man, but the law is the law.
