PORT ST. LUCIE — A 19-year-old man accused of having sex with a 15-year-old girl was arrested Thursday morning on a felony charge, an arrest affidavit states.

Joseph John Waller, of the 1000 block of Southwest Coleman Avenue, was arrested just after 2 a.m. on a charge of lewd or lascivious offense committed upon a person under 16.

The victim’s mother found Waller trying to hide under the victim’s bed when she checked on her daughter between 1 a.m. and 1:10 a.m., police said.

The affidavit gives this account:

Waller told police the victim invited him over, and that his wife recently kicked him out of his home.

Asked of his intentions, Waller said, “She’s 15, I know she’s illegal.”

He admitted having sex with the victim about a week ago at the home of a friend of the victim. He said she told him her age after the sexual encounter.

Waller also said the victim’s parents told him not to be around their daughter or home again. He said he’s spent the night there since the warning.

The victim said she met Waller, listed as unemployed, “through a friend of a friend.” He told her he’d been kicked out of his home. She felt bad and offered to sneak Waller into her bedroom, acknowledging they had sex one time.

She said they weren’t planning anything other than sleep as police arrived.
